1. Agreement to Terms#

By accessing or using Galaxy Gaming Host LLC's services ("Service", "Services", "Galaxy Gaming", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Galaxy Gaming Host LLC is a Florida Limited Liability Company providing Virtual Private Server (VPS) hosting, game server hosting, and related infrastructure services.

1.1 Documents Incorporated by Reference#

The following documents are incorporated into these Terms by reference and form part of your binding agreement with us. By accepting these Terms, you accept all of them. You should read each one before placing an order.

Acceptable Use Policy — what you may and may not do with our Services
Privacy Policy — how we handle your personal data
Refund Policy — refunds, cancellations, and chargebacks
DMCA Policy — copyright notices and counter-notices
Cookie Policy — cookies and similar technologies
Service Level Agreement — uptime commitments and service credits, where applicable
Data Processing Agreement — applies where we process personal data on your behalf under GDPR or similar law
Reseller Agreement — applies only to authorized resellers
API Terms of Use — applies only if you use our API

1.2 Order of Precedence#

If a conflict arises between documents, the following order of precedence applies, from highest to lowest: (1) any separately signed written agreement between you and us, (2) the Data Processing Agreement, in respect of data protection matters only, (3) the Reseller Agreement, in respect of reseller activity only, (4) the API Terms of Use, in respect of API use only, (5) these Terms of Service, (6) all other policies.

1.3 Eligibility#

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction if higher, and legally capable of entering into a binding contract, in order to use the Services. If you are ordering on behalf of an entity, you represent that you have authority to bind that entity.

2. Account Terms#

2.1 Account Registration#

You must be at least 18 years old or have parental consent to use our Services
You must provide accurate, complete, and current information
You are responsible for maintaining the security of your account credentials
You are responsible for all activities under your account
You must immediately notify us of any unauthorized use

2.2 Account Security#

You may not share account credentials with third parties
We reserve the right to suspend accounts showing suspicious activity
Multi-factor authentication is strongly recommended
You are liable for any damages resulting from your failure to secure your account

3. Acceptable Use Policy#

3.1 Prohibited Activities#

You agree NOT to use our Services for:

Illegal Activities: Any activity violating federal, state, or local laws
Malicious Software: Hosting, distributing, or deploying malware, viruses, ransomware, or exploits
Network Abuse: DDoS attacks, port scanning, packet flooding, or network exploitation
Spam: Mass unsolicited emails, SMS spam, or automated messaging systems
Copyright Infringement: Hosting pirated software, media, or materials violating DMCA
Cryptocurrency Mining: Unauthorized or excessive mining operations (contact us for approved mining use)
Adult Content: Pornography or sexually explicit material (unless explicitly approved)
Harassment: Doxxing, harassment, hate speech, or targeting individuals/groups
Proxy/VPN Abuse: Operating open proxies or VPNs used for illegal activities
Resource Abuse: Intentionally consuming excessive resources to degrade service quality
Reselling: Reselling services without written authorization

3.2 Game Server Specific Terms#

You are responsible for content uploaded by your game server users
You must comply with game publisher terms of service
You must moderate user-generated content on your servers
We reserve the right to suspend servers hosting pirated game clients

3.3 Enforcement#

First violation: Warning and requirement to cease activity
Second violation: Service suspension for 24-48 hours
Third violation: Permanent termination without refund
Severe violations (illegal content, attacks): Immediate termination and law enforcement referral

4. Service Terms#

4.1 Service Availability#

Our standard uptime commitment is 99.5%, as set out in the Service Level Agreement
We do not guarantee uninterrupted or error-free service
Scheduled maintenance will be announced at least 48 hours in advance when possible
Emergency maintenance may be performed without notice
DDoS attacks or external events may impact availability
Service Level Agreements (SLAs) are provided separately for eligible plans

4.2 Resource Limits#

VPS plans have defined CPU, RAM, disk space, and bandwidth limits
Fair use policy applies - sustained excessive usage may result in throttling
Abuse of "unlimited" features will be addressed on a case-by-case basis
We reserve the right to migrate or suspend services exceeding reasonable usage

4.3 Backups#

YOU ARE RESPONSIBLE FOR YOUR OWN BACKUPS
We may provide courtesy backups but do not guarantee data retention
We are not liable for data loss under any circumstances
Backup restoration services may incur additional fees

4.4 IP Addresses#

IP addresses remain property of Galaxy Gaming Host LLC
IP addresses may be changed with 7 days notice
Additional IP addresses may incur monthly fees
IP addresses must be released upon service termination

5. Payment Terms#

5.1 Billing#

All prices are in USD unless otherwise stated
Services are billed in advance on monthly, quarterly, or annual cycles
Payment is due immediately upon invoice generation
Late payments may result in service suspension after 72 hours
A $10 late fee may be applied to payments overdue by more than 7 days

5.2 Payment Methods#

We accept credit cards, PayPal, and cryptocurrency (where available)
Failed payments will be retried up to 3 times
You are responsible for keeping payment methods current
Chargebacks may result in immediate account termination

5.3 Price Changes#

We reserve the right to modify pricing with 30 days notice
Existing subscriptions will be honored at current rates until renewal
Price increases will not exceed 20% per year for existing customers

5.4 Taxes#

Prices do not include applicable taxes
You are responsible for any taxes, duties, or fees imposed by your jurisdiction

6. Refund Policy#

See our separate Refund Policy document. Generally: - New services: 72-hour money-back guarantee - Setup fees, domain registrations, and licenses are non-refundable - Refunds are not provided for terms of service violations

7. Data and Privacy#

7.1 Data Ownership#

You retain all rights to your data and content
You grant us license to process and store your data for service delivery
We will not access your data without permission except for:
Abuse investigations
Technical support (with your consent)
Legal compliance requirements

7.2 Data Processing#

We comply with applicable data protection laws (GDPR, CCPA)
Data is stored in secure facilities within the United States
We use industry-standard encryption for data in transit and at rest

8. Intellectual Property#

8.1 Our Property#

Galaxy Gaming name, logo, and branding are our intellectual property
Our control panel, software, and documentation are proprietary
You may not reverse engineer, copy, or redistribute our software

8.2 Your Property#

You retain ownership of your uploaded content
You are responsible for ensuring you have rights to content you upload
We may remove content violating intellectual property rights upon valid DMCA notice

9. DMCA Compliance#

Galaxy Gaming Host LLC complies with the Digital Millennium Copyright Act.

9.1 Copyright Infringement Notices#

Include: 1. Identification of copyrighted work claimed to be infringed 2. Identification of infringing material and location on our services 3. Your contact information 4. Statement of good faith belief 5. Statement of accuracy under penalty of perjury 6. Physical or electronic signature

9.2 Counter-Notices#

If you believe content was removed in error, you may submit a counter-notice following DMCA procedures.

9.3 Repeat Infringers#

Accounts with multiple valid DMCA claims will be terminated.

10. Limitation of Liability#

10.1 Service Warranty Disclaimer#

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Damages#

TO THE MAXIMUM EXTENT PERMITTED BY LAW: - Galaxy Gaming Host LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages - Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim - We are not liable for data loss, business interruption, or lost profits

10.3 No Liability For#

Third-party services, content, or actions
User-generated content on your servers
DDoS attacks or other malicious activities targeting your services
Acts of God, natural disasters, or events beyond our control
Your violation of these Terms

11. Indemnification#

You agree to indemnify and hold harmless Galaxy Gaming Host LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: - Your use of the Services - Your violation of these Terms - Your violation of any third-party rights - Content you upload or transmit through our Services - Actions of your server users or customers

12. Termination#

12.1 Termination by You#

You may cancel services at any time through your control panel
Cancellations take effect at the end of the current billing period
No refunds for partial months unless covered by our refund policy

12.2 Termination by Us#

We may suspend or terminate services immediately for: - Violation of these Terms or Acceptable Use Policy - Non-payment after grace period - Illegal activities or content - Actions threatening our infrastructure or other users - Fraudulent activity

12.3 Effect of Termination#

In the event that we terminate your Services for any reason, any remaining balance or credit for unused time already paid for is forfeited in full, and no refund, credit, or pro-rated reimbursement will be issued.
All your data will be deleted within 7 days of termination
You remain liable for all charges incurred before termination
Outstanding balances remain due and payable
Forfeiture of prepaid amounts is in addition to, and not in place of, any other remedy available to us

13. Changes to Terms#

13.1 Modification Rights#

We reserve the right to modify these Terms at any time
Material changes will be announced via email 30 days in advance
Continued use after changes constitutes acceptance
If you disagree with changes, you may terminate your account

Current version effective date is listed at the top
Previous versions available upon request

14. Dispute Resolution#

14.1 Governing Law#

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions.

14.2 Jurisdiction#

Any disputes arising from these Terms or Services shall be resolved in the state or federal courts located in Florida. You consent to personal jurisdiction in these courts.

14.3 Informal Resolution#

Before filing any legal action, you agree to contact us to attempt informal resolution.

14.4 Arbitration (Optional - consult attorney)#

14.5 Class Action Waiver#

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

15. General Provisions#

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Galaxy Gaming Host LLC.

15.2 Severability#

If any provision is found unenforceable, remaining provisions remain in full effect.

15.3 Waiver#

Failure to enforce any right or provision does not constitute a waiver of such right.

15.4 Assignment#

You may not assign or transfer your account without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure#

We are not liable for failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, government actions, internet failures, or hacker attacks.

15.6 Survival#

Sections regarding payment obligations, intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
